1. Service Description

AvatarAI provides an AI-powered service that transforms uploaded photographs into professional-quality headshots in various styles. The service is provided "as is" and results may vary based on input photo quality and selected styles.

2. Account Registration

You may need to create an account to use our service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account.

3. User-Uploaded Content

You represent and warrant that:

• You own or have the legal right to upload any photos you submit
• Any person depicted in uploaded photos has consented to the use of their image for AI headshot generation
• Uploaded content does not violate any third-party rights, laws, or regulations
• You will not upload content involving minors without parental consent

Prohibited Content: You must not upload photos that contain nudity, explicit content, hateful imagery, or content that violates any applicable law.

4. AI-Generated Content Ownership

You retain ownership of the photos you upload. The AI-generated headshots produced from your uploads are licensed to you for personal or commercial use depending on your plan:

• Basic Plan: Personal use only
• Pro Plan: Personal and commercial use with license
• Enterprise Plan: Full commercial license with no restrictions

5. Payment Terms

All payments are processed securely through Stripe. We accept Visa, Mastercard, American Express, and other major credit/debit cards. Prices are listed in USD and are one-time payments unless otherwise stated.

6. Refund Policy

We offer a 30-day money-back guarantee. If you are unsatisfied with your AI-generated headshots, contact us within 30 days of purchase for a full refund. Refunds are processed to the original payment method within 10-14 business days.

Refund requests may be denied if AI headshots have been extensively downloaded or used commercially.

7. AI Service Limitations

• AI-generated results vary based on input quality. We do not guarantee specific outcomes
• Service availability is not guaranteed 100% of the time due to server maintenance or technical issues
• We reserve the right to reject any upload that violates our content policies
• Processing times may vary depending on demand

8. Intellectual Property

The AvatarAI brand, website design, AI models, and underlying technology are the intellectual property of BestSell Trading Limited. You may not reproduce, distribute, or create derivative works from our service or technology.

9. Limitation of Liability

To the fullest extent permitted by law, BestSell Trading Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the service.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the service ceases immediately, but your existing AI-generated headshots remain accessible for the duration of your paid plan.

11. Governing Law

These Terms are governed by the laws of Hong Kong. Any disputes shall be resolved in the courts of Hong Kong.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or website notice. Continued use of the service after changes constitutes acceptance.
